Court allows Avery's attorney to submit extended brief

MADISON (WLUK) – The state Court of Appeals has granted a request by Steven Avery’s to submit a brief nearly three times the standard length.

Avery is again appealing his conviction for the 2005 murder of Teresa Halbach.

His attorney, Kathleen Zellner, faces a May 21 deadline to file the latest brief with the appeals court in Madison.

On Friday, she asked permission to file a 31,000-word brief, instead of the usual 11,000-word maximum.

On Monday, the court approved the request, according to the clerk’s office.

Figuring 250 words per page, Zellner would be expected to file about a 124-page document instead of usual 44 pages.

The brief was originally due in January, but Zellner received extensions to March 30 and then May 21.

After Avery’s brief is filed, prosecutors will be given a chance to respond.

Meanwhile, Avery’s nephew, Brendan Dassey, is waiting to hear if the U.S. Supreme Court will take up his appeal.
