Suspected intoxicated driver arrested after falling off roof

APPLETON (WLUK) -- A suspected intoxicated driver fell from the roof of a garage as police were chasing him overnight on Appleton's north side.

Appleton police say they were called to the intersection of E. Marquette and N. Union streets around 11:30 p.m. Thursday for a report of a disabled vehicle. When an officer arrived, he saw two people get into a truck and speed away. The officer followed the vehicle until it stopped a short distance away. The driver got out and ran through a yard while the passenger stayed in the vehicle.

Another officer who was called to the scene saw the man lying on the roof of a garage at a house in the 400 block of E. Lindbergh Street. As the officer shouted commands at the man, he got up and climbed to the peak of the roof. He ignored the officer's commands, but eventually fell off the other side of the roof. He was then arrested.

Police say they discovered that the man was carrying a baggie of marijuana.

The man complained of back pain and was taken to the hospital. While at the hospital, officers gave him field sobriety tests, which he failed. He was arrested for third-offense operating while intoxicated.

The man, identified as 26-year-old Kyle J. Davis, was also jailed on suspicion of eluding, resisting arrest and possession of marijuana. He is being held on a probation violation. No formal charges have been issued yet, however.

Meanwhile, the passenger in the vehicle was identified as a 30-year-old man from Menasha. He was ticketed for marijuana possession and released after speaking to officers.
